President Dr. Muizzu has established a special presidential commission to investigate how the Maldives acted in the dispute over the Chagos maritime boundary, known locally as the Folhavahi case.
The commission has been formed under the powers vested in the President by Article 115(c) of the Constitution, under the name "Presidential Special Commission to Investigate the Maldives' Conduct in ITLOS Case No. 28".
According to the President's Office, the commission was set up because reports by international experts have suggested that a large part of the Maldives' maritime area was lost as a result of the way the Maldives handled the case brought by Mauritius before the International Tribunal for the Law of the Sea (ITLOS). The President's Office said this has caused an irreparable loss to the country's fisheries and marine resources.
Members of the commission
- Chair: Ustaz Ahmed Shakir (recipient of the Nishan Dhiyamigili honour)
- Abdul Azeez Yoosuf
- Dr. Aminath Shafiya Adam
- Dr. Abdul Muhsin Mohamed
- Retired Deputy Commissioner of Police Mohamed Sadiq
- Ahmed Alimanik
- Ustaza Fathimath Minhath Izzath
The commission's main mandate is to examine how state employees, advisers and political officials acted in the ITLOS case and to investigate whether there was any legal negligence on their part.
It is also tasked with determining the action to be taken against those found to have been negligent, and with submitting recommendations to the President on arrangements to prevent such a situation from recurring in the future.
The commission will remain in place until the President determines that its assigned work has been completed.
